Terms and conditions

1. Scope of Application

These general terms and conditions (GTC) apply to all deliveries by MiriMari Modedesign OG to consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

  1. Contracting Party

The purchase contract is concluded with MiriMari Modedesign OG, Managing Director: Mirjana Topalovic, registered in the Commercial Register at the District Court of Feldkirch under the company number FN 514888 p.

  1. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the [Buy / Order for payment] button, you submit a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after we receive your order.

  1. Right of Withdrawal

If you are a consumer (i.e., a natural person who places the order for a purpose that cannot be attributed to their commercial or independent professional activity), you are entitled to a right of withdrawal according to the statutory provisions.

If you exercise your right of withdrawal, you will bear the regular costs of returning the goods. In addition, the following detailed provisions of the cancellation policy apply:

Cancellation Policy:
You have the right to withdraw from this contract within fourteen days without providing any reason.

The withdrawal period is fourteen days from the day you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us with a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. If you use this option, we will promptly send you a confirmation of receipt of your withdrawal.

  1. Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including the delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day we receive your notification of withdrawal from this contract.

For the refund, we will use the same payment method you used for the original transaction, unless you have expressly agreed otherwise. No fees will be charged to you for the refund.

We may refuse the refund until we have received the goods back or until you have provided proof that you have sent the goods back, whichever occurs earlier.

You must return the goods without undue delay and in any event no later than fourteen days from the day you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You will bear the direct costs of returning the goods.

You are only required to compensate for any loss in value of the goods if this loss in value is due to handling the goods in a way that was not necessary to inspect the nature, characteristics, and functioning of the goods.

  1. Prices and Shipping Costs

In addition to the prices stated, we charge a reasonable shipping fee for national and international deliveries. The shipping costs will be clearly communicated to you in the shopping cart system and on the order page. No further taxes or costs are incurred.

  1. Delivery

Delivery is made worldwide by an appropriate shipping service provider. The delivery time is indicated on the respective product page and/or on the order page.

  1. Payment

Payment can be made by advance payment, bank transfer, credit card, or PayPal.
If you choose the payment method advance payment, we will provide you with our bank details in the order confirmation. Delivery will be made after payment has been received.

  1. Retention of Title

The goods remain our property until full payment has been made.

  1. Dispute Resolution

The EU Commission provides a platform for online dispute resolution (OS platform). This serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations from online purchase contracts.
